Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and RankSky.si (“RankSky”, “we”, “us”) for the RankSky service, website, dashboard, tag and related features (the “Service”) at rankspy.si. By creating an account, installing the tag or using the Service, you accept these Terms and our Privacy Policy. If you accept for a business, you confirm you are authorised to bind it, and “you” means that business.

2. The Service

RankSky gives you a JavaScript tag for your online store. Once installed and verified, the tag records product page views and shows a popup at the bottom-left of your pages featuring either your most-viewed product (Automatic mode) or a product you choose (Custom mode). Product views are counts of page visits. They are not sales data.

3. Accounts

• You must be at least 18 and use the Service for business purposes.
• Give accurate account information and keep it up to date.
• Keep your password secure. You are responsible for activity under your account. Tell us at once at support@rankspy.si if you suspect unauthorised use.
• One account may be used for the store registered on it, unless we agree otherwise.

4. Free trial and subscription

• Free trial: new advertisers get 90 days free. No payment method is needed to start.
• Subscription: after the trial, the Service costs $5 per month (plus any applicable taxes), billed monthly in advance through our payment provider.
• If you don't subscribe when the trial ends, the popup is paused on your store until a subscription is active. Your account and settings are kept.
• Renewal: subscriptions renew automatically each month until cancelled.
• Price changes: we will give at least 30 days' notice by email before a price change applies to you.
• Failed payments: if a payment fails, we may pause the popup until it is resolved.

5. Cancellation and refunds

You can cancel at any time. Cancellation takes effect at the end of the current paid month, and the popup stays live until then. Fees already paid are non-refundable, including for partial months, except where the law requires otherwise. To cancel or ask about billing, email support@rankspy.si.

6. Installing the tag — your responsibilities

• Install the tag only on websites you own or are authorised to manage.
• Tell your visitors about the Service in your privacy policy and comply with notice and consent laws that apply to your store. Our Privacy Policy includes suggested wording.
• Accuracy of claims: you decide what is featured and how it is labelled. Make sure the popup, including the “Top Selling Product” headline and the name, image and price, is accurate and not misleading under consumer-protection and advertising laws. In Automatic mode the featured product is your most-viewed product, not necessarily your best-selling one.
• You must have the rights to any product names, images and content shown through the Service.
• Keep the tag code unchanged. Altered tags may stop working and are not supported.

7. Acceptable use

You must not use the Service to:

• promote illegal, harmful, deceptive or infringing products or content;
• inflate, fake or manipulate view counts, or send automated traffic to our systems;
• interfere with, overload, reverse-engineer or bypass the security of the Service;
• collect personal information about shoppers through the Service, or try to identify them;
• resell or provide the Service to third parties without our written permission.

8. Intellectual property

The Service, including our software, tag, designs and brand, belongs to us and our licensors. While your account is in good standing, we give you a limited, non-exclusive, non-transferable licence to install and use the tag on your registered store. If you send us feedback, we may use it without any obligation to you.

9. Your content and data

You keep all rights to your store's content. You give us permission to read, store and display your product information and view counts only as needed to provide and improve the Service. We handle personal information as described in our Privacy Policy.

10. Availability and changes

We work to keep the Service running smoothly, but we do not guarantee it will be uninterrupted or error-free. We may improve, change or retire features. Features such as the SI Scan preview may change at any time. If we make a change that significantly reduces the Service for paying advertisers, we will tell you in advance.

11. Third-party services

The Service relies on third parties such as hosting and payment providers, and works alongside your own store platform, themes, cache and security tools. We are not responsible for third-party services or for conflicts they cause, for example caches that serve old copies of your pages.

12. Disclaimers

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular increase in traffic, conversions or sales.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your store, the products and claims you feature, your breach of these Terms or your violation of any law or third-party right.

15. Suspension and termination

You can close your account at any time by emailing support@rankspy.si. We may suspend or end your access if you breach these Terms, fail to pay, or use the Service in a way that could harm us, shoppers or other advertisers. Where reasonable, we will notify you first. Sections 6, 8, 12, 13, 14 and 16 survive termination.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and disputes will be handled by the competent courts of India. If you are a consumer, you keep any mandatory protections of the country where you live.

17. Changes to these Terms

We may update these Terms. We will post the new version here with a new “Last updated” date and, for significant changes, notify advertisers by email or in the dashboard at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
